A Peoria County, Illinois Jury needed only 28
minutes to find Robert Boucher's client NOT
GUILTY of his
3rd DUI Charge, which involved
a Serious Motorcycle Accident.  Prosecutors
had presented what they thought was sufficient
evidence against Mr. Boucher's client,
including, Eye Witness testimony that his Client
was operating a Harley Davidson "Chopper" at
time of crash, Police Officers testifying that his
Client concealed himself after the crash, an
Illinois State Crime Lab
Forensic Scientist who
qualified as an
EXPERT WITNESS, and testified
that his Alcohol content was
.14, and a witness
who testified that his Client confessed to driving
the motorcycle while under the influence of
alcohol.
Mr. Boucher also stipulated that his Client's
Drivers License was Suspended at time of
crash.

The seven men and five women of the Jury
deliberated and returned a verdict of
NOT GUILTY IN 28 minutes on all counts,
including DRIVING ON SUSPENDED LICENSE
and DRIVING UNDER THE INFLUENCE OF
ALCOHOL.

Mr. Boucher commented that effective Defense
Counsel assist juries to understand and strictly
apply the Constitutional principle of
Presumption of Innocence and the burden of
proof beyond a reasonable doubt that the
Government must establish to convict his clients.

Fulton County NOT GUILTY verdict
in DUI Jury Trial quickest in recent
memory.
Driving his vehicle 89 mph
in a 55 mph zone, with alcohol in the
vehicle, and a veteran Police Officer
testifying that Robert Boucher's Client
was "obviously highly impaired" and
under the influence of alcohol, was all
insufficient evidence to secure what
Government prosecutors were
seeking.  In less than 30 minutes of
deliberations, the Jury returned a
verdict of
NOT GUILTY.
During his final arguments, Mr.
Boucher admonished the Jury to
disregard their personal prejudice and
apply the law.  "Drinking and driving is
not against the law, only driving while
drunk.  The evidence that the
Government presented was
insufficient to convict".  Mr. Boucher
instructed the Jury to return a verdict
of NOT GUILTY, which they did in
record time.
